Terms of Use
Last Updated: November 4th, 2024
Welcome to DuePort. By accessing or using our services, you agree to these Terms of Service (ToS). Please read them carefully before proceeding.
1. Introduction
DuePort is a software-as-a-service (SaaS) platform that enables businesses to contact and collect balances owed by their commercial clients. DuePort is strictly for business-to-business (B2B) debt collection activities and may not be used to pursue consumer debt collection from individuals. DuePort is not a collection agency but a tool to facilitate the self-directed recovery of outstanding balances. In some cases, and only with the explicit approval of the DuePort user, the platform may involve the assistance of partner organizations.
By using DuePort, you acknowledge and agree to these Terms of Service.
2. Service Integration
DuePort offers integration capabilities with accounting and invoicing software that users may already utilize. Users have full control over specifying which applications DuePort can access and are provided multiple options to limit or revoke such access at any time. It is the user's responsibility to configure these integrations securely and ensure they comply with relevant laws and regulations.
3. User Responsibilities
Prohibited Uses
Users are expressly prohibited from:
Engaging in illegal activities, including but not limited to the sharing, storing, or distribution of illegal images, pirated content, cybercrime, hate speech, harassment, or promotion of violence.
Engaging in fraudulent, deceptive, or misleading practices.
Using DuePort in any manner that violates applicable laws or regulations or that is harmful to DuePort’s reputation.
Security Obligations
Users must ensure secure methods are employed to connect to data sources, such as strong passwords and secure networks.
Users are responsible for maintaining the security and confidentiality of their account credentials.
4. Data Privacy and Security
At DuePort, we prioritize data privacy and security.
We store excerpts of your data, encoded to maintain security and ensure compliance with best practices.
Row-level access permissions are implemented to restrict data visibility to your organization.
Data is serviced and stored using Amazon Web Services (AWS), a highly secure cloud infrastructure.
DuePort does not share user data beyond what is already integrated with third-party services at the user's discretion.
For more details, refer to our Privacy Policy.
5. Intellectual Property
Users retain ownership of the data accessed via DuePort.
Third-party intellectual property rights must be respected at all times when using the platform.
DuePort retains ownership of any usage data or insights generated by the platform for performance and optimization purposes.
6. Restrictions on Use
DuePort may only be used to recover debts arising from commercial transactions between businesses. Users are expressly forbidden from using the platform for consumer debt collection from individuals, as defined under the Fair Debt Collection Practices Act (FDCPA). This includes any debts incurred for personal, family, or household purposes.
Misuse of DuePort for consumer debt collection will result in immediate termination of access, and potential legal action may be pursued.
7. Changes to the Service
We reserve the right to modify or update the platform, including its features and functionalities, at any time.
Major changes will be communicated via email using our best efforts, but prior notice is not guaranteed.
All changes will be documented and posted within the application.
8. Refund Policy
DuePort offers a 30-day free trial applicable to the fixed monthly fee (excludes collection or processing fees).
Refunds are available upon request by emailing info@DuePort.com.
Refunds will apply to the most recent billing period only.
9. Age Restrictions
All users of DuePort must be at least 16 years of age. By using the platform, you confirm that you meet this minimum age requirement.
10. Limitation of Liability and Indemnification
Users agree to indemnify, defend, and hold harmless DuePort, its affiliates, and its employees from any claims, damages, or expenses arising from misuse of the platform, including but not limited to violations of these Terms of Service or applicable laws.
DuePort is not liable for any indirect, incidental, or consequential damages resulting from your use of the platform.
11. Acceptance of Terms
By accessing or using DuePort, you acknowledge and agree to these Terms of Service. These terms constitute a legally binding agreement between you and DuePort.
